Conditions of participation for the Instagram COMPETITION "ZF BKK summer prize"
1. participation
The prize draw is in no way connected to Instagram or Facebook and is in no way sponsored, supported or organized by Instagram or Facebook. The organizer of the prize draw is ZF BKK.
Participation is free of charge. Natural persons aged 18 and over who are resident in Germany are eligible to participate. Minors from the age of 14 are entitled to participate if their legal representative agrees to their participation. Participants (hereinafter uniformly referred to as "participants") are responsible for the accuracy of the data they enter.
Pooling is excluded from participation. Participation via competition services, automated mass participation procedures of third parties or other manipulation is not permitted.
Employees of ZF BKK and their relatives, as well as the companies involved in the prize draw, are also excluded from participating in the prize draw.
The prize draw begins on 10.07.2025 and ends on 15.09.2025 at 23:59. Participation in the prize draw is only possible during this period (participation period).
The prize draw comprises one round, which will take place during the participation period. As described in the post about the prize draw, participants can take part in the prize draw by liking and commenting on the very first post in the new ZF BKK design. All participants will be entered into a random draw to win 1x 2-night stay for 2 people at the Biohotel Mohren, Deggenhausertal (Lake Constance region).
The winner will be contacted at the end of the draw to find out their address. The prize will be sent to the winner by post or e-mail after verification of the prize by ZF BKK.
By commenting on the entry, the participant accepts the conditions of participation. By participating, the participant agrees that his/her name may be published on the ZF BKK Instagram profile and may be commented on by third parties. The participant grants ZF BKK free of charge the rights of use, which are unlimited in terms of subject matter, time and territory.
Each participant can only take part in the prize draw once. The first comment left is relevant for participation. The winner will be drawn at random from all participants at the end of the specified participation period. The draw will take place in camera.
The participant agrees that, if they win, their Instagram name will be published on the ZF BKK Instagram page and also on the ZF BKK Facebook page.
ZF BKK reserves the right to check the winner before and after publication and to exclude the winner whose comment does not comply with the following conditions at any time after becoming aware of this:
The entrant must not infringe any third party rights. In particular, but not limited to, the participant must ensure that the comment/content does not infringe any copyright, trademark or other rights of third parties.
In particular, unlawful, racist comments / content that violate the protection of minors is prohibited. Comments / content with the following content are not permitted: advertising, celebrities, models, photos with an Internet or e-mail address displayed and photos that are likely to cause offense. No content may be published that contains the following elements:
(i) information about political or religious beliefs from the participant or a third party;
(ii) derogatory remarks towards a third party or members of a particular population group, nationality, gender, sexual orientation or religion;
(iii) anything that is offensive or exclusionary;
(iv) anything that in any way reveals information of a private nature, is sexually offensive or glorifies violence;
(v) anything that portrays a company in a negative light;
(vi) anything that promotes the participant's products or services that are not related to the prize draw.
ZF BKK reserves the right to disqualify any participant who violates these conditions of participation. ZF BKK may modify, suspend or terminate the prize draw if this should be necessary due to force majeure or external circumstances beyond the control of ZF BKK or if this is the only way to ensure that the prize draw can be carried out properly.
In the event of disqualification or deletion of the participant's content due to a violation of applicable law and/or these conditions of participation, as well as in the event of modification, suspension or termination of the prize draw by ZF BKK, the participant shall not be entitled to any claims for compensation against ZF BKK.
If the submitted content violates the rights of third parties or otherwise violates the conditions of participation, the participant shall indemnify ZF BKK against all third-party claims and the costs of the associated legal defense. An infringement of third-party rights is deemed to have occurred, for example, if third-party texts, images or videos are used for the participant's own contribution without the consent of the respective rights holder.
The participant agrees that his/her Instagram name may be published on the corresponding channel in the event of further use by ZF BKK.

2. prize
The prize is:
1x 2 nights for 2 people at the Biohotel Mohren, Deggenhausertal (Lake Constance region)
A cash payment of the prize or a possible prize replacement is not possible. The prize is non-transferable. The journey to the Biohotel Mohren must also be organized by the respective winner (hereinafter uniformly referred to as "winner"). ZF BKK will not cover any travel costs. The prize is not financed by ZF BKK membership contributions.
The winners will be informed via Instagram Direct at the end of the prize draw. For organizational reasons, each winner must respond within 24 hours with their address via Instagram Direct or by email to marketing@zfbkk.de. If no response is received during this period, the prize will be forfeited. The prize will be sent to the winner by post or email. The prize is non-transferable.
3. data protection notice
By participating in the prize draw, the participant expressly agrees that ZF BKK may collect, store and use personal data for the purposes of conducting the prize draw and, if necessary, forward it to third parties for this purpose.
The data will be treated confidentially and deleted after the end of the prize draw, insofar as this is within ZF BKK's sphere of influence. In accordance with the statutory provisions, every participant has the right to access their data and to have it corrected, blocked or deleted. By withdrawing consent, the participant withdraws from participation in the prize draw.
4 Liability
ZF BKK is not liable for the constant and uninterrupted availability of the online systems used, nor for technical and electronic errors of a telemedia service over which it has no influence.
5 Miscellaneous
By participating in the prize draw, the participant accepts these conditions of participation and the data protection notice.
The law of the Federal Republic of Germany shall apply exclusively.
Should any of these provisions be or become invalid, this shall not affect the validity of the remaining conditions of participation.
ZF BKK is entitled to adapt the content and information contained herein as well as these conditions of participation to changes in the legal framework. ZF BKK reserves the right to cancel the prize draw at any time without prior notice if there is an important reason (e.g. viruses in the computer system, manipulation or errors in the application). Legal recourse is excluded.
